Terms of Service

Your contract is with New Map (the “Provider”). The provider information is in the Impressum, which forms part of these Terms. Contact: hello@thenewmap.ai.

New Map measures how a brand appears in the answers of AI engines such as ChatGPT, Perplexity, Gemini, Google AI Overviews and AI Mode, Claude and Grok; provides an AI account manager and further AI agents that read that data, propose a plan and draft deliverables such as llms.txt, schema markup, Answer Library pages, proof pages and outreach briefs; and, on request and under a separate scope, arranges PR, thought leadership, SEO placements and creator campaigns through New Map's network of human specialists (“Distribution”). What the Service includes for you, and any fee, is agreed directly with New Map (section 4).

You must give accurate information and keep credentials confidential. You are responsible for everyone who uses the Service under your account and must tell us at once at hello@thenewmap.ai if you suspect unauthorised access. Users must be at least 18. Unless agreed otherwise in writing, access covers one brand in one language.

Access to the Service and any services are arranged directly with New Map. Nothing is charged through the platform. Any fee is agreed in writing before the access or work it covers begins, and that agreement states the amount, any VAT and when it is due. Statutory rights on default remain unaffected.

You keep all rights in the brand information, documents, websites, repositories, contracts and other material you provide (“Your Content”). You grant New Map a non-exclusive licence to store, analyse and process Your Content, and to pass it to the processors named in the Privacy Policy, for the purpose of providing the Service for as long as your account exists. You confirm you hold the rights needed to share Your Content and that it contains no data you are not permitted to disclose. Personal data is processed under the Data Processing Agreement, which forms part of these Terms.

Deliverables drafted for you (texts, files, briefs, plans) become yours to use for your business once any fee agreed for them is paid; New Map keeps the rights in its platform, agents, prompts, methods, models, templates and data structures, and grants you a non-exclusive, non-transferable right to use the platform for as long as your access lasts. Measurement data is licensed to you for internal business use and may not be resold or published as a benchmark of third parties without our consent.

We may derive aggregated, de-identified statistics from the use of the Service and from measurement data (for example which content types move AI answers in which categories) to operate and improve the Service and to publish benchmarks. These statistics never identify you, your users or your customers, are never sold, and are never used to train a third-party AI model. Your identifiable data serves only you: Your Content and your conversations with the account manager are not shared with other clients.

The account manager, the sales agent and the drafting agents are AI systems. Their output is generated, may contain errors and is not legal, financial, tax or investment advice. New Map checks drafts against your data with an automated verifier and marks them as AI-generated, but you review, edit and approve everything before you publish it, and you are responsible for what you publish. AI visibility figures are sampled from AI engines on stated prompts and dates; they are directional, vary from run to run and are not an audited ranking. AI engines are operated by third parties whose behaviour we do not control. New Map therefore does not guarantee any specific mention, citation, position, traffic, ranking or business result, nor that any outlet, creator or list will accept a placement; Distribution work is an obligation to perform the agreed activities with care, not to achieve a result. A paid placement is delivered when the agreed article or listing is published on the named outlet, labelled as advertising where the law requires and with the link attribute that outlet uses; no citation, visibility, traffic or other outcome is promised for it. Where you publish AI-generated text produced by the Service to inform the public on matters of public interest, you are responsible for the disclosure the EU AI Act requires of you as the publisher; drafts carry an AI-generated marker so you can do that.

The Service reads and reports what third-party AI engines answer. Those engines change without notice, may stop being measurable, and are not ours. If an engine or a data provider withdraws access, we will replace it with an equivalent where we can; if we cannot and the Service loses a material part of its value, you may end the agreement with immediate effect. When you connect a third-party account (for example Google Analytics) you authorise us to read the data you select and you can disconnect at any time, which deletes the token. You must comply with the terms of the platforms you ask us to act on, and you must not ask us to publish content that those platforms prohibit, including undisclosed paid editing on Wikipedia.

You may not use the Service to break the law or infringe rights of others, to publish misleading or deceptive material, to submit content you are not entitled to, to probe, disrupt, scrape or reverse-engineer the Service, to resell it, or to build a competing product from its output. You may not submit personal data of other people beyond business contact details and material you are entitled to share; you may not use the Service to generate content that misrepresents a product, a person or a market; and you may not use the Service if you, your company or its owners are subject to EU, UK, US or UN sanctions. We may suspend access where conduct threatens the Service, other customers or third parties, and will tell you why.

Support is by email to hello@thenewmap.ai and through the account manager in the portal. We answer on business days (Berlin time) and aim to respond to a report that the Service is unusable within one business day, and to everything else within three business days. We aim for high availability but do not guarantee a specific uptime unless agreed in writing; planned maintenance is announced in the portal where practicable, and third-party AI engines and data providers are outside our control.

Each party keeps the other's non-public information confidential and uses it only to perform the contract, except where disclosure is required by law; this survives the contract by three years. We name you as a customer, or publish results about you, only with your prior consent in text form.

Defects in the Service will be remedied within a reasonable time after notice. The statutory warranty rules apply, with the limitation that claims for defects lapse one year after delivery of the relevant deliverable or performance, except in the cases named in section 15 where the statutory periods apply.

If you send us suggestions about the Service, we may use them without obligation to you. This does not apply to Your Content or your confidential information.

New Map is liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where it has given a guarantee. For slightly negligent breach of an essential contractual duty (a duty whose fulfilment makes proper performance possible in the first place and on whose fulfilment you regularly rely), liability is limited to the damage that was foreseeable and typical for this type of contract when it was concluded, and in total to the fees you paid in the twelve months before the event; for Amplify, PR retainers and other Distribution work, the cap is the amount fixed for that engagement in the written quote. Any further liability for slight negligence is excluded. The same applies to our employees, agents and processors. Liability for loss of data is limited to the cost of restoring it from reasonable backups.

You indemnify New Map against third-party claims and reasonable costs arising from Your Content, from material you publish, or from your breach of these Terms, unless New Map is responsible for the claim.

Either party may end the agreement at the end of any calendar month by notice in text form, unless a written agreement sets another term. Either party may terminate for cause without notice; cause includes material breach not cured within 14 days of a written warning, and non-payment of an agreed fee after a reminder. On termination your access ends; you can export your deliverables and data before the end date, and we delete or return personal data as set out in the Data Processing Agreement.

We may change these Terms for good reason, for example new features, changes in the law or in our providers. We will notify account holders by email at least 30 days before a change takes effect; if you do not object before that date, the change applies. If you object, either party may end the agreement before the change takes effect. Changes that would alter the main obligations to your disadvantage need your express agreement.

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Text form (email) satisfies any requirement for writing in these Terms. If a provision is invalid, the rest remains in force; the invalid provision is replaced by the statutory rule.

For clients in the United States: nothing renews or is charged automatically through the platform, and any fee is agreed in writing beforehand (section 4). Nothing in these Terms limits rights that cannot be limited under the law of your state. You confirm that you are not located in, and will not use the Service from, a country subject to comprehensive EU or US sanctions, and that neither you nor your owners are on an EU, UK, US or UN sanctions list.
